XPPen Affiliate Terms & Conditions

Please read our affiliate terms and conditions carefully before you join our program or begin marketing of our program. These terms and conditions are written in plain language intentionally avoiding legalese to ensure that they may be clearly understood and followed by affiliates. Each affiliate is responsible for assuring that its employees, agents and contractors comply with these terms and conditions. Once you apply and joining in our program, it means that you agree to abide by our policy, terms and conditions. 

Definitions

1) “We”,“us”, or “our” refers to XPPen and our websites;

2) “You”or “your” refers to the affiliate;

3) “Our website” refers to the XPPen properties located at all our domains;

4) “Your website” refers to any websites that you will link to our website;

5) “Program” refers to the XPPen Affiliate Program.

1. Enrollment in the Affiliate Program

First, you need to submit a complete Affiliate Program Application. Including all of the websites that you use in your profile will help us make a better decision. After receiving your application, we will evaluate your website and notify you if we have accepted or rejected your application. Your application will be reviewed within 48 hours for working days. You may be declined from the program if your website content is not a match for us, features inappropriate content, and/or your listed URL is invalid. We reserve the right to reject any application, however, we encourage you to contact us if you feel we have made an incorrect decision.

2. Allowed Advertising Channels

○ Forum

○ Loyalty

○ Reviews

○ Content sites

○ Coupon sites

○ Sub-networks

○ Cashback sites

○ Comparison sites

○ Deal and promocode sites

○ Social Media Optimization (SMO)

○ Search Engine Optimization (SEO)

○ Bloggers, Vloggers and Social media influencers

○ Publisher links in public groups and communities in social networks, etc.

3. Forbidden Advertising Channels

○ Incentive

○ Illegal website

○ Brand Bidding

○ PopUp/ClickUnder

○ Retargeting/Remarketing

○ Sexually explicit material or violence

○ Targeted advertising in social networks

○ Brand Keywords PPC/Paid Search/SEM

○ Generic Keywords PPC/Paid Search/SEM

○ Discrimination based on race, sex, religion, national origin, or physical disability

○ Doorway Traffic, Email Marketing, Push Notifications, Teaser/Banner Advertising, Short Message Service Marketing (SMS)

4. Limit Spam

You cannot utilize SPAM in promoting the Company. This action will result in the immediate termination of Affiliate account with a cancellation of any pending commissions. You will also be in violation of the Company’s Affiliate Agreement and subject to legal action and be held liable for any financial loss incurred by the Company. 

For the purpose of this agreement SPAM is defined as emailing ANYONE, in bulk or by single mailing, about The Company who has not specifically requested the information directly from Affiliate. 

5. PPC Bidding Rules

1) Affiliates are prohibited to bid on the following:

○ Branded/trademarked terms

○ Derivatives of branded/trademarked terms

○ Broad-match based on branded/trademarked terms

Example: XPPen, XPPEN, XP-PEN, XP-Pen, xppen, xp-pen, xppen.com, storexppen.com, and all kinds of misspellings or variations, etc.

2) Direct links to our website from any Pay-Per-Click ad or use redirects that yield the same result are NOT allowed. 

3) Google Ads and Facebook Ads are NOT allowed, but not limited to those.

4) Search Engine Marketing is NOT allowed.

6. Publicity Restrictions

1) You shall not create, publish, distribute, or permit any written material that makes reference to us without first submitting such material to us and receiving our written consent, including the XPPen Logo.

2) Never attempt to modify or copy storexppen.com or XPPen logo in any manner.

3) Never declare or act as a representative for XPPen as an affiliate, which is not available for affiliates.

4) Affiliate cannot be working with XPPen by drop shipping, any drop shipping order won't be commissioned.

5) Fraud is defined as any action that intentionally attempts to create sales, leads, or click-through using robots, frames, iframes, scripts, or manually "refreshing" of pages, for the sole purpose of creating commissions.

6) DNS hijacking, domain hijacking, and any black hat technology are not allowed.
Attempt to modify or alter our Site in any way, make any representations, either express or implied, or create an appearance that a visitor to your website is visiting our Site, e.g., "framing" or "wrapping" the Site, which is forbidden by XPPen.

7. Use of Logos

Unauthorized logos, endorsements or certification of XPPen may not be used.

8. Coupon Code Usage

Affiliates may not advertise coupon codes obtained from non-affiliate marketing channels, including from our website or email newsletter. Any promotions outside of those available on our affiliate program ad campaign list will be considered unauthorized. Permission to use coupon codes outside of what we offer through our program must be supplied in writing.

9. Federal Trade Commission (FTC) Disclosure

All affiliates are required to adhere to the Federal Trade Commission guidelines as it relates to disclosing compensation.

10. Transactions

1) Transaction values that commissions are paid on do not include: 

○ Sales tax

○ Delivery fees

○ Credit card fees

○ Additional service fees

2) Commissions will not be paid on gift cards and may be declined for the below reasons:

○ Item returned

○ Order canceled

○ Duplicate order

○ Customer failed credit check

○ Breach of program terms and conditions

Our Responsibilities

We will be responsible for providing all information necessary to allow you to make appropriate Links from your site to our site. We will be solely responsible for processing every order placed by a customer following a special Link from your site, for tracking the volume and amount of sales generated by your site, and for providing information to Affiliate Sites regarding sales statistics.We will be responsible for order entry, payment processing, shipping, cancellations returns, and related customer service.

Your Responsibilities

You are solely responsible for ensuring that reviews, descriptions, and articles on your site comply with applicable copyright, FTC disclosure and other laws. You must have express permission to use another party's copyrighted or other proprietary material. We are not responsible for violations.

Penalty for Violation
Violation of XPPen affiliate terms and conditions may result in void of sales and commissions or even removal from all of XPPen affiliate programs.

XPPen reserves the right to update, suspend, discontinue, change or otherwise modify this Terms of Use Agreement for Affiliates at any time. When changes are made, notification will be made through the Site, network blog or email. At that time affiliates may either agree to notified changes or withdraw from the Network.
